    If the series is partly a fiction and many shortcuts have been operated (it is not a documentary and the family of Bernard Tapie is very angry with the directors), this confrontation really existed in reality. Former Minister and Patron of OM, he actually met in 1993 Éric de Montgolfier, the Valencian prosecutor during a strange meeting during which the businessman tried to convince the magistrate to abandon The prosecution in the case of the fake va-om match which will precipitate his fall (he will be sentenced to several months in prison). Today retired, Éric de Montgolfier looked at the series and returns to this meeting.

    Point : You saw the series Lurking, What did you think ? And have you recognized yourself in the character of the magistrate who made Tapie fall ?

    Éric de Montgolfier: The series is pleasant to look at and does not fall into caricature even if many events are treated in a fairly complacent way for Bernard Tapie. It is undoubtedly difficult to be represented on the screen and I did not recognize myself in this deceitful prosecutor who plays the cat and the mouse with Tapie throughout their first meeting. What we said to ourselves did not have this intensity. The dialogues and the remarks that I am lent to me are in fact the compilation of moments of the trial. This is normal, since apart from Tapie and I, there were no witnesses !

    I actually told Tapie the following sentence: “You could have been a constellation, you were a meteor. But at the hearing, during the indictment. Not during this meeting. The series also presents me playing with light as if to blind Tapie, like a commissioner of the 1950s. It’s totally false. On the other hand, it is true that her chair was quite low and that mine was high enough. It was not a choice on my part but an inheritance of my predecessor. It put very uncomfortable. He got up, he walked long and wide in the room to try to convince me.

    But on the merits, how this strange meeting took place with Bernard Tapie in 1993 ?

    The series presents a Bernard Tapie who is embedded in my office at nightfall while I am about to go home. My character pretends not to recognize him and play the little judge lost in his stacks of files, delighted to see Tapie fall into the mouth of the wolf. Things did not spend at all ! Tapie had offered to see myself outside the palace, which I obviously refused. It was a test. The meeting had been organized by his lawyer who, after a few minutes, left us alone.

    Officially, when I hadn’t asked him anything, he wanted to explain to me how professional football works to which, I did not know anything. At the hearing, when the debates concerned football, I happened to say when I had a microphone: “I knew I was zero in football. But not at this point ! But we were not soccer referees on land. In this case, what was important was corruption. This meeting aimed above all to try to seduce me, because Tapie worked like that. He started by telling me that he came out of the Élysée, which justified his delay ..

    Tapie has tried several strategies with me, such as flattery or connivance. He was not used to being resisted him.

    That you answered him ?

    My strategy was a little finer than the one I was lent to in the series. So I said little. I had overwhelming elements that materialized the reality of the rigged match. In the afternoon of this meeting, the gendarmes had found a large sum of cash buried in the garden of the aunt of a Valenciennes player. But I didn’t tell her about it. I didn’t give her a moral. I have never done it before someone I could one day continue. It is not the role of a prosecutor. Unlike Tapie who wanted to go quickly and settle this case quickly, the time of justice is long. And that’s probably what annoyed him the most.

    But have you been seduced by this character ?

    He came to tell me that this affair was insignificant, in impression that I had better to do. He tried several strategies, such as flattery (“a great prosecutor like you in such a small court ! ), Connivance (“One of my friends who knows you well told me that I could talk to you …”). He was not used to being resisted him. Finally, it was impossible, in 1993, to ignore who was lurking. So we had to stay on the facts. And finally forget the character. Outside the Va-Om affair, I have always had an esteem for him. He had talent. He was not unfriendly.

    On the other hand, and I told him, I think he did not use his resources positively and for the common good. He should have used his energy otherwise. His career, especially in politics, was disastrous for the credibility of public affairs. This is why my indictment was so severe. Not at all because I didn’t like Tapie. But because he had been a member of the government. As such, he should never have had this behavior. Policies, like magistrates, must be exemplary. This is why I was scandalized by the case of the “Wall of the idiots”, these magistrates who targeted certain policies ridiculously. They have devalued the image of justice.

    The series ignores the pressures ..

    They were very numerous. Those of the media, some of which were fans. Those of public opinion, since part of the French remained fascinated by the character. Those of politicians: we were in full cohabitation and at the Elysée as in Matignon, we followed the fate of Bernard Tapie with great attention. He tried to put pressure at the highest level. Those of the Chancellery. However, I knew well how it works and I did not have too many illusions on the career maneuvers of some-I say some-of my elders, because I had worked a little younger. I was not fooled and the career was not my engine.

    I had also already worked on Tapie in the past and on a file that the series evokes, his company Coeur Assistance. It was already a matter in which political pressures were very important. Other pressures, that of the Friends of Tapie: I think of Edmonde Charles Roux (the wife of the mayor of Marseille) who once said: “Montgolfier, unlike Tapie was born with a silver spoon in the mouth”, trying to cause a kind of class struggle in the media by pointing my surname. A classic approach to discredit a magistrate. I also had the PJ of Lille which warned me: “You have a contract on your head. But I refused to be protected. If a magistrate begins to be afraid, he must open a grocery store. My duty was to contribute to justice to be serenely.
